These Terms of Service (“Terms”) and Privacy Policy (“Policy”) govern your use of SewManager (the “Service”), a platform specifically designed for managing sewing-related businesses, including features such as task management, customer relationship management, and more. By using our service, you agree to these Terms and understand how we collect, use, and protect your data, so please read both sections carefully. If you do not agree to these Terms or our Privacy Policy, you must not use our services.

Terms of Service

  1. Acceptance of Terms By accessing or using SewManager (“Service”), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Service. SewManager reserves the right to modify these Terms of Service at any time, and your continued use of the Service constitutes acceptance of any changes.
  2. Service Description SewManager provides a cloud-based customer relationship management (CRM) and business management solution specifically designed for the sewing industry. This includes features such as lead management, task tracking, pricing management, class scheduling, and more. SewManager reserves the right to modify, update, or discontinue the Service or any part thereof at its discretion, without prior notice.
  3. Eligibility By using SewManager, you represent and warrant that:
    • You are at least 18 years of age and have the legal capacity to form a binding contract.
    • You will provide accurate, current, and complete information during the registration process and maintain the accuracy of such information.
    • You will use the Service solely for lawful purposes and in compliance with all applicable local, state, national, and international laws and regulations.
  4. User Accounts and Security You are responsible for maintaining the confidentiality of your login credentials and account information. You agree to:
    • Notify SewManager immediately of any unauthorized use of your account or breach of security.
    • Ensure that you properly log out from your account at the end of each session.
    SewManager is not liable for any loss or damage arising from your failure to comply with these security obligations.
  5. Prohibited Uses You agree not to engage in any of the following activities while using the Service:
    • Illegal Activities: Engaging in illegal or fraudulent activities, including but not limited to, hacking, phishing, or distributing malicious software.
    • Intellectual Property Violations: Uploading, sharing, or distributing content that violates the intellectual property rights of others.
    • Abuse or Harassment: Harassing, threatening, or defaming other users, or using the Service to send spam or unsolicited messages.
    • Tampering: Attempting to gain unauthorized access to the Service, or any systems or networks associated with SewManager, or otherwise interfering with the operation of the Service.
    SewManager reserves the right to suspend or terminate your account if you violate any of the above prohibited uses.
  6. Billing and Payment For paid features of the Service, you agree to provide accurate and complete billing information. You authorize SewManager to charge your designated payment method for all applicable fees related to your use of the Service.
    • Subscription Fees: All subscription fees are due in full at the time of purchase and are non-refundable unless otherwise specified.
    • Late Payments: If your payment method is declined or payment is not made by the due date, SewManager reserves the right to suspend or terminate your access to the Service.
    SewManager reserves the right to modify its pricing and payment terms at any time, and such changes will be communicated to you in advance.
  7. User Content You retain all ownership rights to the content you create and upload to SewManager, such as customer data, task records, and other related materials. By uploading content to the Service, you grant SewManager a non-exclusive, worldwide, royalty-free license to use, display, and distribute the content solely for the purpose of providing the Service. You are solely responsible for ensuring that any content you upload complies with applicable laws and does not infringe upon the rights of third parties. SewManager may, but is not obligated to, monitor user content and reserves the right to remove any content that violates these Terms.
  8. Intellectual Property Rights All intellectual property rights, including but not limited to, trademarks, service marks, logos, and copyrighted materials associated with SewManager, are the exclusive property of SewManager. You agree not to copy, reproduce, distribute, or create derivative works from any part of the Service without prior written consent from SewManager.
  9. Disclaimer of Warranties The Service is provided on an “as-is” and “as-available” basis. SewManager makes no warranties, express or implied, regarding the Service, including but not limited to, the accuracy, reliability, or availability of the Service. You use the Service at your own risk. SewManager disclaims all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  10. Limitation of Liability To the fullest extent permitted by law, SewManager and its affiliates, officers, employees, and agents will not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use or inability to use the Service, including but not limited to, damages for loss of profits, data, or other intangible losses, even if SewManager has been advised of the possibility of such damages.
  11. Indemnification You agree to indemnify, defend, and hold harmless SewManager and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of or related to:
  • Your use of the Service.
  • Your violation of these Terms of Service.
  • Your infringement of any third-party rights, including but not limited to, intellectual property rights.
  1. Termination SewManager reserves the right to suspend or terminate your account or access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may terminate your account by discontinuing the use of the Service and contacting customer support.
  2. Governing Law and Dispute Resolution These Terms of Service are governed by the laws of Washington State, without regard to its conflict of laws principles. Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association or the appropriate governing body in your jurisdiction.
